我朋友的外甥和他的同学3月27号去秀山布*牛扒餐厅财富中心店上班，做到8号，两个都是马上要平凯职高毕业了，都顺利达到重庆师范大学本科线。本想利用假期打点零工，后来分数线出来后填好志愿。学校要求他们还得继续回去学习，修一个专业职称后才能顺利领到毕业证。他们就没有提前给老板打招呼（因事出太紧急缘故）就辞职离开了那家店。之后问老板要他们辛苦劳动的十来天工资，老板却拒绝给他们支付十多天工资，具体情况就是这样。老板以没提前给他打招呼离职为由，拒付他们工资，还说现在招不到人来什么的理由。遇到这样的情况他们该怎么去解决？希望有了解的告诉我一下，谢谢！去劳动局因没有签订劳动合同无法立案！<br>

如果当时说的是招做兼职，那这个钱就是必须要给；如果当时明确说招长期，那就有点悬，（秀山很少招暑假工，很多学生都说做长期然后做个月就说家里有事来不了，说走就走，很多商家承受不起）。任何地方辞职都会默认提前一个月说，除非暑假工。秀山很多地方入职会说要压工资，如果没提前说辞职你走了就会把压的工资扣了！（不过这是违法的）不管入职有没有辞职相关约定，这笔钱都是你的应得的，你有这个权利要回这笔钱！没有合同不是问题，只要收集你在他的店里上班的证据，照样可以去告他，除非……总结：①都是成年人，工作要对自己、商家负责，②不管兼职、长期做了几天就该给几天的钱，老板没良心+不靠谱！</td></tr></tbody></table>
