<p style="line-height:30px;text-indent:2em;text-align:center"><font face="仿宋_GB2312"><font style="font-size:26pt"><font color="#000000">谁来纠正违章建设行为</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:center"><font color="#000000"><font face="仿宋_GB2312"><font style="font-size:15pt">“鼎泰中央豪庭”违章建设始末</font></font><font face="黑体"><font style="font-size:22pt"></font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="黑体"><font style="font-size:16pt"><font color="#000000"></font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font size="5"><font color="#000000">“鼎泰中央豪庭”系由秀山市政建设开发有限公司开发建设的商住楼。地处重庆市秀山县渝秀大道与凤翔路交叉口，为旧城改造项目。该建设项目严重违反了《重庆市城市规划管理技术规定》，至今施工单位仍在违法施工。</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font color="#000000"><font face="仿宋_GB2312"><font style="font-size:15pt"><br>
</font></font><font face="仿宋_GB2312"><font style="font-size:15pt">“鼎泰中央豪庭”建设项目在2007年初开工建设，当年10月被责令停止建设。原因是该建设项目违反城市规划：</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font color="#000000"><font face="仿宋_GB2312"><font style="font-size:15pt">1</font></font><font face="仿宋_GB2312"><font style="font-size:15pt">、该项目建设损害公共利益</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font style="font-size:15pt"><font color="#000000">“鼎泰中央豪庭”项目西临主干道站前大道，按《重庆市城市规划管理技术规定》第三十四条规定：“高层建筑计算高度大于60米时，主楼退让道路红线：临主干道不小于7米”。而该项目实际施工中主楼退让不足3米。2007年，秀山县政府责令该项目停止建设。</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font style="font-size:15pt"><font color="#000000">时隔两年之后，项目开发单位未进行任何设计变更的情况下，为什么又能重新开工建设呢？</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font color="#000000"><font face="仿宋_GB2312"><font style="font-size:15pt">2</font></font><font face="仿宋_GB2312"><font style="font-size:15pt">、该建设项目将埋下重大安全隐患</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font style="font-size:15pt"><font color="#000000">“鼎泰中央豪庭”为住宅式高层建筑，投入使用后将形成约1800人生活的住宅小区。该建筑西临渝秀大道与风翔路交叉口红绿灯下，与道路红线不足3米；其余三面均与其他建筑间距狭窄，突发事故时，人员无法安全疏散，必将埋下重大交通和公共安全隐患。县政府2007年停止其建设，今后的安全隐患也是原因之一。</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font color="#000000"><font face="仿宋_GB2312"><font style="font-size:15pt">2</font></font><font face="仿宋_GB2312"><font style="font-size:15pt">、该项目与边界外永久性建筑物的间距违反《重庆市城市规划管理技术规定》</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font style="font-size:15pt"><font color="#000000">该项目建筑南侧与XX大酒店（建筑高度约25米）大楼北侧主采光面间距仅5.2米，北侧与民宅（建筑高度15米）南侧、东侧与民宅西侧（XXX住户和XXX住户，建筑高度15米）间距均仅2米，与《重庆市城市规划管理技术规定》第23条的规定“相邻两栋住宅建筑山墙之间的间距：旧城改造区不小于6米，新建区不小于8米”相差甚远，根本无法保证建筑间的安全间距。</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font color="#000000"><font face="仿宋_GB2312"><font style="font-size:15pt">2009</font></font><font face="仿宋_GB2312"><font style="font-size:15pt">年11月，XX酒店将此情况向县人大反映后，县人大责成县规划局实地核实。县规划局经实地核实后，认定该建设项目违章，并承诺将责令建设方停止施工，调整设计。</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font style="font-size:15pt"><font color="#000000">但县规划局的决定成了一纸空文，两个多月来，建设方不仅没有停止施工、调整设计，而是变本加厉不分白天黑夜的加紧施工，妄图将违章建设造成既成事实，这其中的猫腻不言而喻。</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font style="font-size:15pt"><font color="#000000">谁来纠正违规建筑？县建委如是说：建筑物不符合规划要求是规划局的事。县规划局明知“鼎泰中央豪庭”违章建设，除了下达一纸空文推卸、规避责任外，不采取任何行政措施。规划是一个城市文明、进步的象征，对正在违反城市规划的行为都不及时制止，难怪民间流传“秀山城市建设每天有30栋楼违章建设，每周只能撤除一栋”的说法。</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font style="font-size:15pt"><font color="#000000">谁在保护违章建筑？行政不作为是违章建筑的最大保护伞。相关的行政管理部门国家公务员一边拿着国家优裕的俸禄，一边用一纸空文干着欺下瞒上的勾当。</font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font color="#000000"><font face="仿宋_GB2312"><font style="font-size:15pt">谁来为违章建筑买单？又该谁来承担违章建筑的责任呢？当城市公共利益受到侵犯时，相关行政管理机关竟如此无能，熟视无睹,这不仅是相关行政职能部门公务员的渎职更是秀山市民的悲哀</font></font><font face="仿宋_GB2312"><font style="font-size:15pt"><font face="Times New Roman">……</font></font></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font style="font-size:15pt"></font></font> </p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font style="font-size:15pt">图一：规划局回复的一纸空文</font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"><font style="font-size:15pt"></font></font></p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312"></font> </p><p style="line-height:30px;text-indent:2em;text-align:left"><font face="仿宋_GB2312">图二：违章建筑未按规定与主干道退让</font></p><p style="line-height:30px;text-indent:2em;text-align:left">
